Responsibilities Position is Remote (Restricted)- The duty station can be the employees' home, however, must be located within the local commuting area of Washington, DC which has been established as 125 miles or 2.5 hours. The applicant would not be required to report to the DOE Worksite every pay period but will be required to do so with some regularity (e.g., a few times a month) for work that cannot be performed remotely. The Department of Energy's (DOE) Office of the General Counsel is looking for a dynamic, innovative, seasoned executive to evaluate the most difficult legal and factual issues facing the Department of Energy Enforcment program. As the Assistant General Counsel for Enforcement you will: Direct the enforcement programs for the Department to ensure consistent application of laws and regulations across the country to all sectors of regulated industries. Direct courses of action when cases may affect agency authority, operations, procedures, or practices. Supervise a staff of experienced attorneys and support personnel; coordinate and integrate efforts of the enforcement attorneys with technical program support and regulatory attorneys. Direct organizational activities, frame strategic plans based on broad organizational assessments and evaluations of long-term organizational objectives. Set all internal control standards for effectiveness, efficiency, and productivity and assess all organizational policy, program, and project viability. Determine the financial and personnel resources needed to achieve mission objectives and support mission operations. Identify the need for major organizational improvements, develop the requisite plans and direct implementing actions. Direct trial attorneys and attorney/advisors on case preparation and prosecution in administrative hearings and federal court. Provide substantive guidance to staff attorneys and determine whether the agency will undertake prosecution of individual cases based on the weight of the evidence, the importance of the case, the necessity of uniform application of the law, the cost of litigation, and other considerations that bear on the advisability of instituting suit. Determine which cases to prosecute, including evaluation of resources, strength of evidence, relationship to other cases, and overall impact on enforcement and compliance efforts. Requirements Conditions of Employment PRE-HIRING REQUIREMENTS: This is a permanent position in the SES. Unless you are already a member of the SES with career status or are a graduate of an Office of Personnel Management (OPM) certified SES Candidate Development Program, your executive qualifications must be approved by OPM before you can be hired. Qualifications Your resume must describe your executive core qualifications (ECQs) and experience, technical qualifications and give a synopsis of your accomplishments. Do not include a separate ECQ narrative. Additionally, Mandatory Technical Qualifications (MTQs) listed later in this section below must be addressed in a separate document. EXECUTIVE CORE QUALIFICATIONS: The five ECQs described below were designed to assess executive-level experiences and potential not technical expertise. They measure whether you have the broad executive skills needed to succeed in a variety of SES positions. 1: Leading Change: Ability to bring about strategic change, both within and outside the organization, to meet organizational goals and establish an organizational vision and to implement it in a continuously changing environment. 2: Leading People: Ability to lead people toward meeting the organization's vision, mission, and goals and provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts. 3: Results Driven: Ability to meet organizational goals and customer expectations and make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks. 4: Business Acumen: Ability to manage human, financial, and information resources strategically. 5: Building Coalitions: Ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. MANDATORY TECHNICAL QUALIFICATIONS (MTQs): As part of your application package, a separate document must be uploaded addressing each MTQ listed below. No more than one page per MTQ is allowed; additional information will not be considered. MTQs must provide specific examples that address relevant experience and accomplishments. Your leadership and management skills must be addressed in the MTQs listed below. Failure to submit a document addressing each MTQ will result in your application to be deemed incomplete and not be considered. MTQ 1: Describe your experience in providing, overseeing, and managing litigation before courts and administrative agencies. Experience ideally should include providing legal advice, representation, and counsel concerning complex civil enforcement and civil penalty or similar litigation matters, and exercising enforcement/prosecutorial discretion. MTQ 2: Describe your experience in conducting and overseeing investigations in complex technical areas, and ideally in the management of teams of attorneys and support personnel in such investigations. MTQ 3: Describe your ability to work with technical experts and rulemaking experts in crafting and enforcing a sound regulatory and enforcement program, ideally in areas related to DOE's energy efficiency and renewable energy programs. Education Must meet the minimum education requirements of successful completion of a full course of study in a school of law accredited by the American Bar Association (ABA) with a professional law degree (L.L.B or J.D.). You must provide a copy of your unofficial transcript(s). Be sure to include those transcripts directly applicable for meeting the education requirements.
