Baystate Health Deputy General Counsel Manager in Springfield, Massachusetts

Summary Description:

Baystate Health, western Massachusetts’s premier healthcare provider, and home to Baystate Medical Center is currently seeking a Deputy General Counsel & Managing Attorney. This position will be commutable remote, the ideal candidate will have the flexibility to easily commute to the home office in Springfield, MA on a regular basis with the ability to work from a home office the remainder of the week. The Deputy General Counsel & Managing Attorney will report to the SVP & Chief Legal Officer and in consultation with Baystate Health management, is responsible for planning, directing, and managing legal services on behalf of the health system in order to ensure legal and regulatory compliance.

Legal services include, but are not limited to, advising administration and senior management and physician leaders in matters of corporate law, enterprise risk management, business transactions, financing, medical staff governance, regulatory compliance, general health law, employment law and labor relations, mergers and acquisitions and litigation.

Ideal candidates will have experience as a health law practitioner as in house counsel with experience with physician contracting and healthcare acquisitions.

The Deputy General Counsel & Managing Attorney is also responsible for managing the day-to-day operations of a department to support the legal needs of Baystate Health, while looking for continued opportunities for better fiscal management and organization of the internal legal function, as well as the use of outside firms. This individual manages an average annual legal spend of several million dollars, as well as the departmental legal staffing budget.

Ideal candidates are h ealth law generalists with 10 years of experience and proven expertise in leading a team focused on physician-hospital arrangements, corporate transactions, medical staff matters, and regulatory and licensure issues with an overall broad health care legal knowledge; in-depth understanding of how legal issues affect health care organizations; ability to contribute to the development of and implement legal strategy and objectives; well-versed in how business operates with financial business acumen.

Responsibilities:

  • Maintains a portfolio of legal work that includes serving as a legal advisor to leadership and other business partners and sharing responsibility for achievement of the organization's goals and objectives.

  • Oversees the day-to-day operations of the Law Department, ensuring that legal services are provided to Baystate Health in a competent and cost-effective manner through, among other things, oversight and supervision of in-house legal staff; oversight and supervision of outside counsel; assisting in legal services budget preparation and adherence; and development of service expectations for legal services. Coaches, mentors, and develops staff; empowers employees to take responsibility for their jobs and goals; and delegates responsibility and expects accountability and regular feedback.

  • Provides legal oversight of the organization's contracting, including vendor and physician services contracting. Develops contract formats and drafts and participates in negotiating major contracts.

  • Works closely with the SVP & Chief Legal Officer to provide legal support to advance key strategic initiatives consistent with the health system’s overall strategic plan. Assures corporate and regulatory compliance in all ventures and structures transactions to achieve the strategic goals and mission of the health system.

  • Functions as legal advisor in corporate and regulatory matters, maintaining favorable relations with all relevant federal, state, and local regulatory and investigatory governmental agencies. Provides advice with respect to regulatory inquiries from state and federal agencies.

  • Ensures the review of and response to subpoenas and summonses as appropriate.

  • Provides or oversees the provision of legal advice concerning Medical Staff governance and advice to Medical Staff leadership on matters concerning credentialing and privileging, as well as corrective action, for members of the Medical Staff and Associate Professional Staff.

  • Serves as leader to department employees and develops process that provides an overall context and framework to encourage employee contribution, including goal- setting, feedback, and performance development planning. Provides effective performance feedback through employee recognition, rewards, and disciplinary action, with the assistance of Human Resources, when necessary.

  • Contributes to the development of and implements a strategy for the department to include a contemporary model of legal services and staffing structure to support the ongoing legal needs of the health system.

  • Maintains ongoing communication with stakeholders to ensure an awareness of the health system's legal services and process for use.

  • Attends a variety of meetings, conferences, and seminars as required or directed. Keeps informed of industry-specific regulations and ensuring that appropriate strategies are in place.

  • Maintains transparent communication with department employees. Appropriately communicates organizational information through department meetings, one-on-one meetings, appropriate email, and regular interpersonal communication.

Minimally Required Experience:

  • 10 years corporate health care legal experience gained through law firm experience, in-house experience, or a combination.

  • Experience managing a team of legal professionals.
