Minimum Qualifications Candidates must be reachable on the appropriate Civil Service eligible list.ORThis title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.Position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected. NON COMPETITIVE MINIMUM QUALIFICATIONSAssistant Attorney 1- Starting Salary $65,001- Must be Law school graduation and/or eligibility for NYS Bar Admission.Assistant Attorney 2- Starting Salary $72,032- Admission to NYS Bar.Assistant Attorney 3- Starting Salary $79,928- 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.Sr. Attorney- Starting Salary $93,530- 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.55 B/C QUALIFICATIONS:Individuals certified eligible for the 55b/c program under the Governor’s Program to Hire Persons/Veterans with Disabilities pursuant to Section 55b/c of the Civil Service Law will also be considered. To be considered, you must meet the minimum qualifications and provide a copy of your letter of eligibility with your response. Candidates must meet the non-competitive minimum qualifications listed above.TRANSFER QUALIFICATIONS:Candidates must have one year of permanent competitive or 55 b/c service in a title designated as appropriate for transfer in accordance with Section 52.6, 70.1 OR 70.4 of the Civil Service law.70.4 transfer candidates must have one year of permanent competitive service in a position allocated to a SG-16 or higher and possess a bachelor’s degree and have standing on the Legal Specialties exam list.

Duties Description These positions will report to an Associate Attorney for the Waiver Agreement Management Office (WAMO) and the 15(8) and 14(6) Special Disability Fund (SDF), which is part of the Special Funds Group (SFG). The Senior Attorney will assist with all legal tasks associated with WAMO and the SDF.Under the direction and supervision of an Associate Attorney, these tasks will include:• Review of settlement recommendations for retail and wholesale waiver agreements; • Assist WAMO & SFG staff with oversight of 14(6) and 15(8) cases;• Review and sign Section 32 settlement agreements;• Legal review and determination on claim specific Special Disability Fund inquiries and issues [i.e., 110-a, 114-a, related cases, Medicare eligibility, Medicare Set Aside approvals, apportionment, voluntary withdrawal];• Draft legal documents and forms related to the oversight of the carrier and employers’ administration of Special Disability Fund claims as well as the resolution, via individual or broader scale agreements, of such claims;• Representation of WAMO or Special Funds Group, as necessary, at 15(8)/14(6) hearings, including Section 32 hearings, and taking any related actions required [i.e., exception, negotiation, stipulation, withdrawal, appeal, rebuttal];• Effectively communicate in writing or by phone with internal and external stakeholders with regard to 14(6)/15(8) claims and other matters;• Assisting in any bonding process related to Special Funds;• Respond to requests for information or action from other board units regarding 14(6), 15(8);• Perform any other tasks and special projects, reports, etc. related to the handling of Special Funds cases or other Financial Administration office matters; and • Oversee work assignments and balance workload of examiners.
