Job Description:

Responsibilities:

  • Analyze new claims identifying potential compensability or legal concerns in the areas of product liability, property damage matters, subrogation claims, and installation;

  • Ability to identify products, their purpose, uses, applications, and manufacturer;

  • Strong understanding of supply chains and product distribution from manufacturer to distributers to end users;

  • Maintain strong knowledge of products central to Ferguson’s and its subsidiaries’ businesses;

  • Handle high volume of claims both in-house and through third party administrator (TPA) from inception through resolution;

  • Handle high volume of lawsuits in active litigation with assistance of TPA and retained outside defense counsel from inception to resolution;

  • Tender claims and litigation to TPA, insurance carrier, manufacturers, suppliers, vendors, and/or installers;

  • Facilitate investigation between Ferguson associates and branches and TPA, carrier, and/or retained defense counsel;

  • Perform and/or direct claim and incident investigation fact gathering and preserving evidence, including working with retained experts to analyze products;

  • Maintain general knowledge of individual federal, state and local laws and regulations relevant to assigned practice areas;

  • Provide location management guidance and advocacy support;

  • Provide timely communication and customer service to customers and claimants during the administration of claims;

  • Evaluate, select and communicate with insurance adjusters, attorneys, experts, medical providers, associates, etc;

  • Establish and maintain business partnership with those involved with each claim, including customers and claimants, to assure clear understanding of corporate objectives, goals, policies, and procedures;

  • Participate in all aspects of litigation management including selection and retention of defense counsel, discovery preparation; file referral, enforcement of carrier reporting requirements, invoice evaluation / payment, strategy development, identification and analysis of jurisdictional specific issues, mediation attendance, etc.;

  • Authority to approve reserve and settlement recommendations up to specified authority amount and negotiate appropriately;

  • Evaluate claims for risk control intervention and assist with the development of appropriate loss and risk mitigation programs. Recognize exceptions as they occur and seek assistance to resolve problems of varying scope and complexity;

  • Assist in developing programs that reduce corporate exposure including the development and presentation of educational material;

  • Participate in claim review sessions;

  • Maintain the integrity, accuracy and thoroughness of claim files providing legally supportive file documentation;

  • Identify and pursue loss recovery opportunities;

  • Extensive use of various claims/risk information systems to monitor and manage claims;

  • Communicate effectively, and maintain professional, collegial, and productive relationships with company associates, witnesses, attorneys, and external partners. Willing to take direction and assignments on a variety of legal matters from supervising attorney.

  • Represent the company in a professional manner at all times ensuring quality customer service;

  • Abide by all policies, rules, and regulations of the company including all applicable safety rules, regulations and procedures;

  • Support corporate programs, goals, and initiatives of the company;

  • Maintain strict confidentiality; and

  • Work hours outside of regularly scheduled hours as needed.

Qualifications:

  • Bachelor’s degree in business or other business related curriculum preferred (or equivalent combination of work and education);

  • Minimum 4 years’ claim adjusting and/or corporate claim experience or 4 years’ Company experience working and product knowledge;

  • Understanding of general claim procedures and loss prevention programs;

  • Strong oral and written communication skills;

  • Ability to interact and communicate with all levels of management;

  • Ability to apply jurisdictional regulations and corporate policies to daily situation and concerns;

  • Ability to present the company’s position persuasively to third parties, including insurance adjusters, attorneys, third party administrators, investigators and state agencies;

  • Excellent organizational and time management skills;

  • Self-motivated, able to work well independently;

  • Ability to learn and adapt to new and innovative software programs;

  • Ability to maintain strict confidentiality;

  • PC literacy in Microsoft Office software (Word, Excel, PowerPoint).
