DRIVERS WILL GENERALLY BE TRANSPORTING CARDBOARD PACKAGING FROM THE WORKSITE STORAGE FACILITY TO FARMS LOCATED THROUGHOUT THE SOUTHEAST AND MIDWEST U.S. IN ORDER FOR FARMERS TO PACKAGE THEIR CROP DIRECTLY ON THE FARM. NO ON THE JOB TRAINING IS REQUIRED OR PROVIDED.PAYROLL INFORMATION: A SINGLE WORKWEEK WILL BE USED AS THE STANDARD FOR COMPUTING WAGES DUE. WEEKLY WAGE PAID EACH WEEK IS BASED ON THE GREATER OF $28.37 PER HOUR BASIS OR ON A PERCENT-OF-REVENUE PER LOAD BASIS. POST-HIRE AND POST-TERMINATION TRAVEL REIMBURSEMENTS: FOR DRIVERS HIRED OUTSIDE REASONABLE COMMUTING DISTANCES TO WORKSITE, WHETHER IN THE U.S. OR ABROAD, TO THE PLACE OF EMPLOYMENT, THE EMPLOYER WILL PAY IN ADVANCE, OR REIMBURSE, BY COMPANY CHECK, THE DRIVER ON THE FIRST PAYCHECK DATE FOR THE FIRST WORK WEEK OF EMPLOYMENT, THE MOST ECONOMICAL AND REASONABLE INBOUND TRANSPORTATION AND LODGING EXPENSES; THE INBOUND DAILY SUBSISTENCE EXPENSES ($15.88 PER DAY WITH MAXIMUM $59.00 PER DAY WITH DOCUMENTATION OF ACTUAL EXPENSE, OR THE CURRENT AMOUNTS PER REGULATIONS); THE CONSULATE VISA, VISA PROCESSING, BORDER CROSSING AND OTHER RELATED FEES, INCLUDING THOSE MANDATED BY THE GOVERNMENT AND INCURRED BY THE EMPLOYEE, EXCLUDING PASSPORT EXPENSES; AND OTHER RELATED INBOUND EXPENSES PRIMARILY FOR THE BENEFIT OF THE EMPLOYEE. THE EMPLOYER WILL PROVIDE OR PAY FOR THE WORKER’S COST OF RETURN TRANSPORTATION AND DAILY SUBSISTENCE FROM THE PLACE OF EMPLOYMENT TO THE PLACE FROM WHICH THE WORKER, DISREGARDING INTERVENING EMPLOYMNENT, DEPARTED TO WORK FOR THE EMPLOYER, IF THE WORKER COMPLETES THE CERTIFIED PERIOD OF EMPLOYMENT (50%) OR IS DISMESSED FROM EMPLOYMENT FOR ANY REASON BY THE EMPLOYER BEFORE THE END OF THE PERIOD, CONSISTENT WITH 655.20(J)(1)(II). EMPLOYEE RESIDENCY DURING PERIOD OF EMPLOYMENT: EACH DRIVER IS ASSIGNED A TRACTOR-TRUCK INCLUDING A SLEEPER BERTH WITH BED, REFRIGERATOR AND OTHER AMENITIES AND HAS BEEN DEEMED BY THE UNITED STATES DEPARTMENT OF LABOR AND THE UNITED STATES DEPARTMENT OF TRANSPORTATION AS ADEQUATE SLEEPING FACILITIES (49 CFR §393.76). DRIVERS WILL GENERALLY RETURN TO THE WORKSITE EVERY 1-2 DAYS. EMPLOYER WORKSITE AMENITIES INCLUDE, AT NO COST TO THE DRIVER, OVERNIGHT PARKING AND BATHROOM FACILITIES. TYPICALLY, DRIVERS WILL PARK AT WORKSITE’S OVERNIGHT PARKING OR OTHER ROAD-SIDE AVAILABLE PARKING (EXAMPLE: MOTEL, TRUCK STOP, REST AREA) AND SLEEP IN THEIR TRACTOR-TRUCK SLEEPER BERTH BED AND UTILIZE ROADSIDE RETAIL AMENITIES (EXAMPLE: FOOD, LAUNDRY, BATH) AT THEIR OWN EXPENSE, AS IS COMMON IN THE INDUSTRY. ALTHOUGHT IT IS NOT THE RESPONSIBILITY OF THE EMPLOYER TO PROVIDE EMPLOYER-PAID RESIDENCY FOR TEMPORARY H-2B EMPLOYEES DURING EMPLOYMENT, AND WHILE DRIVERS HAVE THE OPTION OF OBTAINING RESIDENCY NEAR THE WORKSITE LOCATION AT THE DRIVER’S OWN EXPENSE AND WILL HAVE EMPLOYER-PROVIDED TRACTOR-TRUCK FOR DAILY TRANSPORATION TO AND FROM THE WORKSITE AND FOR REASONABLE ACCESS TO RETAIL SHOPS AND PERSONAL ACTIVITIES, FOR THE BENEFIT OF THE DRIVER, DUE TO THE DEFINED TEMPORARY NATURE OF THIS EMPLOYMENT COUPLED WITH THE UNIQUENESS OF THIS OCCUPATION, DRIVERS WILL BE ALLOWED CONTINUOUS RESIDENCY WITHIN THEIR ASSIGNED SLEEPER-TRACTOR-TRUCK WITH REASONABLE FREEDOM OF MOVEMENT IN-LIEU OF OBTAINING RESIDENCY NEAR THE WORKSITE AT THE DRIVER’S OWN EXPENSE, BUT COMPENSIBLE ON-DUTY HOURS ARE DEFINED WITHIN THE FOLLOWING JOB DUTIES SECTION. JOB DUTIES: ALL DUTIES ARE COMMON TO COMMERCIAL TRUCK DRIVERS, INCLUDING DRIVING TRACTOR-TRAILER FROM PRODUCT PICKUP LOCATIONS TO DELIVERY LOCATIONS TIMELY AND SAFELY ON PUBLIC AND INTERSTATE HIGHWAYS WHILE OBEYING ALL APPLICABLE LAWS AND REGULATIONS PERTAINING TO COMMERCIAL MOTOR VEHICLES; MANEUVER TRACTOR-TRAILER INTO LOADING AND UNLOADING POSITIONS; CONTACT THE EMPLOYER IMMEDIATELY AFTER THE LOADING OR UNLOADING OF EACH ORDER; MOVE LOADED AND UNLOADED TRAILERS INTRA-YARD; VERIFY SECURE, SAFE AND PROPER CARE OF THE TRACTOR-TRAILER AND OF THE LOADED PRODUCT TO INCLUDE ANY PRODUCT CARE INSTRUCTIONS THAT MAY BE REQUIRED PER EMPLOYER’S VERBAL INSTRUCTION TO THE DRIVER AS WELL AS THE ORDER’S WRITTEN INSTRUCTIONS LOCATED ON ITS BILL OF LADEN PAPERWORK AND DRIVER MUST CONTACT EMPLOYER IMMEDIATELY REGARDING ANY QUESTIONS OF PRODUCT CARE. IN ADDITION, DUTIES INCLUDE COMPLETING AND DOCUMENTING PRE-TRIP AND POST-TRIP SAFETY INSPECTIONS ON TRACTOR-TRAILER AS REQUIRED BY LAW (49 CFR §396.11); PERFORM MINOR MAINTENANCE AND SAFETY DUTIES FOR THE TRACTOR-TRAILER COMMON TO COMMERCIAL TRACTOR-TRAILER TRUCK DRIVERS (EXAMPLE: ADD FLUIDS, CHANGE WINDSHIELD WIPERS, ETC.); ACCURATELY COMPLETE ALL EMPLOYER PROVIDED DRIVER AND TRACTOR-TRAILER WEEKLY ACTIVITY PAPERWORK; CONTINUOUS AND ACCURATE ENTRIES IN THE ELECTRONIC LOGGING DEVICE (ELD) AS REQUIRED BY LAW (SECTION 32301(B) OF THE COMMERCIAL MOTOR VEHICLE SAFETY ENHANCEMENT ACT, ENACTED AS PART OF THE MAP-21 ACT) AS WELL AS MAINTAIN A COMMERICAL DRIVER DAILY PAPER LOGBOOK; READ AND INTERPRET MAPS TO DETERMINE VEHICLE ROUTES AND USE GLOBAL POSITIONING SYSTEMS (GPS) TO SUCCESSFULLY NAVIGATE TO A SPECIFIC LOCATION; UPLOADING REQUIRED DOCUMENTS DAILY VIA EMPLOYER PROVIDED ELECTRONIC APP(S); ALL OTHER DUTIES DIRECTED BY THE EMPLOYER THAT ARE COMMON TO COMMERCIAL TRUCK DRIVERS. DRIVER IS TO ACCEPT DISPATCH ORDERS DIRECTLY FROM EMPLOYER ONLY. DRIVER’S DAILY ON-DUTY HOURS CONSIST OF HOURS OF EMPLOYER DIRECTED ACTIVE DRIVING; HOURS OF ACTIVE TRACTOR-TRAILER OR PRODUCT CARE; HOURS OF ACTIVE OR PASSIVE MONITORING OF DOCKTIME DURING THE LOADING AND THE UNLOADING OF TRAILER; HOURS FOR THE COMPLETION OF REQUIRED PAPERWORK AND ELECTRONIC DATA ENTRY; AND ALL OTHER EMPLOYER DIRECTED ACTIVE HOURS COMMON TO THE INDUSTRY THAT WILL VARY WITH NEED. ON-DUTY DRIVERS WILL HAVE NO ASSISTANT. DRIVER’S DAILY OFF-DUTY HOURS CONSIST OF HOURS NOT OTHERWISE DESCRIBED HEREIN AS ON-DUTY HOURS. DRIVERS WILL BE OFF-DUTY AFTER SECURING THEIR TRUCK AND THEIR LOADED OR UNLOADED TRAILER AND FREE TO SPEND TIME FOR ACTIVITIES OF THEIR OWN CHOOSING, INCLUDING SLEEPING, BREAKS, DINING, SHOPPING, READING, USING A MOBILE DEVICE, WALKING, ETC.WORK ENVIRONMENT: POSITION INCLUDES SPENDING MANY ON-DUTY AND OFF-DUTY HOURS ON THE ROAD IN A TRACTOR-TRAILER TRUCK WITH 80,000-POUND MAXIMUM GROSS VEHICLE WEIGHT (GVW) THAT INCLUDES A SLEEPER BERTH WITH BED, REFRIGERATOR AND OTHER AMENITIES AND HAS BEEN DEEMED BY THE UNITED STATES DEPARTMENT OF LABOR AND THE UNITED STATES DEPARTMENT OF TRANSPORTATION AS ADEQUATE SLEEPING FACILITIES (49 CFR §393.76). DAILY TRAVEL REQUIREMENTS GENERALLY INCLUDE TRAVELING FROM THE WORKSITE AND THROUGHOUT THE SOUTHEAST AND MIDWEST U.S. TO LOCATIONS WITHIN 1-11 HOURS TRAVEL RADIUS, GREATLY DEPENDENT ON TRAFFIC CONDITIONS, FROM THE WORKSITE AND WILL GENERALLY RETURN TO WORKSITE EVERY 1-2 DAYS. DRIVER WILL GENERALLY WORK 5-6 DAYS EACH WEEK, MONDAY THROUGHT SATURDAY, BETWEEN THE HOURS OF 7 AM TO 7 PM, INCLUDING BREAKS. SUNDAY WORK MAY BE REQUIRED. FOR SAFETY REASONS, WORK DAYS AND WORK HOURS MAY VARY AS DRIVER IS FREE TO ACCEPT OR TO DECLINE ANY NEW ORDER BASED ON DRIVER’S READINESS AND WILLINGNESS AT THE TIME THAT A NEW ORDER IS OFFERED TO THE DRIVER BY THE EMPLOYER, BUT DRIVER IS GENERALLY REQUIRED TO WORK APPROXIMATELY THE MAXIMUM WEEKLY NUMBER OF DAYS AND HOURS ALLOWABLE BY THE DEPARTMENT OF TRANSPORTATION (DOT), FEDERAL MOTOR CARRIER SAFETY ADMINISTRATION’S (FMCSA) HOURS-OF-SERVICE (HOS) REGULATIONS (49 CFR PART 395). GENERALLY, FEDERAL DOT HOS REGULATIONS LIMIT COMMERCIAL TRACTOR-TRAILER DRIVERS TO 14-HOUR DAILY AND 60-HOUR, 7-DAY WORKWEEK. OTHER JOB REQUIRMENTS: AN EMPLOYER PROVIDED ON-BOARD CAMERA SYSTEM IS REQUIRED AND SHALL NOT BE OBSTRUCTED BY THE DRIVER. ALL HOURS WILL ALSO BE REGULATED BY THE DEPARTMENT OF TRANSPORTATION (DOT), FEDERAL MOTOR CARRIER SAFETY ADMINISTRATION’S (FMCSA) HOURS-OF-SERVICE (HOS) REGULATIONS (49 CFR PART 395). DRIVERS WILL BE SCHEDULED BY THE EMPLOYER BUT MUST JOINTLY MANAGE THEIR OWN DOT FMCSA HOURS-OF-SERVICE, AS IS COMMON TO THE INDUSTRY. DRIVER MUST COMPORT HIMSELF OR HERSELF IN A PROFESSIONAL MANNER AT ALL TIMES SO AS NOT TO CAUSE A DISRUPTION WITH EMPLOYER’S CUSTOMERS, EMPLOYER’S VENDORS, EMPLOYER’S MANAGEMENT OR EMPLOYER’S OTHER EMPLOYEES. EMPLOYER DRUG & ALCOHOL POLICY: EMPLOYER HAS STRICT RULES REGARDING DRUG & ALCOHOL CONSUMPTION. DRIVER CANNOT CONSUME OR BE UNDER THE INFLUENCE OF ALCOHOL WITHIN FIVE HOURS PRIOR TO STARTING HIS OR HER SHIFT OR WHILE ON-DUTY. NO ALCOHOL OR ILLIGAL SUBSTANCES ARE ALLOWED IN THE TRACTOR-TRAILER OR ON EMPLOYER PROPERTY. DRIVER IS SUBJECT TO EMPLOYER-PAID POST-HIRE, POST-ACCIDENT, SUSPICION OF USE AND RANDOM DRUG AND ALCOHOL TESTING. TOOLS & SUPPLIES: DRIVER WILL BE PROVIDED, WITHOUT CHARGE OR DEPOSIT, ALL TOOLS, SUPPLIES AND EQUIPMENT REQUIRED TO PERFORM THE DUTIES ASSIGN, IN ACCORDANCE WITH 20 CFR 655.20(K). EMPLOYER TIME OFF & VACATION POLICY: THIS JOB OFFER PROVIDES NO TIME OFF PAY. DRIVER IS NOT ENTITLED TO VACATION TIME FOR THE DURATION OF THE CONTRACT. DRIVERS MUST REQUEST SPECIFIC UNPAID WORKDAY(S) OFF WITH AT LEAST 5 DAYS ADVANCE NOTICE AND MUST BE APPROVED AND SCHEDULED BY THE EMPLOYER.
