KBR’s global business comprises two main segments – Sustainable Technology Solutions (STS) and Government Solutions (GS). This role sits within STS in the Integrated Solutions business unit. Integrated Solutions is the engineering and project delivery group providing services which include front-end and detailed engineering, procurement, construction services, and program management primarily in the hydrocarbons and energy transition industries.

KBR is looking for a Commercial Manager - Pre-Contracts

The Commercial Manager is an integral member of the businesses operational function. Working in collaboration with functional Subject Matter Expert’s (SMEs) (e.g. Legal, Tax, Insurance, Finance, Procurement, Subcontracts, Project Controls, Sales, Project Management, Engineering and Construction) to ensure projects are delivered in accordance with contractual requirements, minimising risk and maximising commercial opportunities.

Pre-Contract Context:

Working in unison with the Sales Team, the Pre-Contracts Commercial Manager will have responsibility for developing, coordinating and communicating the commercial strategy. This focus will commence from the initial engagement with potential customers through to formal bid submission, and will provide support and guidance during project execution.

Duties:

  • Supporting the review of tender documentation - with particular focus on contractual drafting, commercial terms and administrative mechanisms.

  • Coordinating and recording all contract documents, including attachments and exhibits (e.g. scope, schedule, rates and prices, exceptions, rely-upon information, etc.), and assist with the incorporation of SMEs feedback and qualifications into KBR’s proposals.

  • Working with Legal and Sales teams to prepare and distribute a consolidated analysis of the contract, highlighting areas of risk and suggested mitigations.

  • Supporting the Sales and Supply Chain Teams in developing commercial strategies for the preparation and finalization for execution of all project related contract documents (including prime contract, joint venture agreements, subcontracts and purchase orders).

  • Understanding the financial implications of the commercial and operational strategy in the context of the businesses risk appetite around areas such as liquidated damages, warranty periods, KPIs, limits of liability and the like.

  • Assisting the Subcontracts and Procurement functions with the development of the Project Subcontracts and Procurement Management Plans during pre-contract negotiations and post-contract administration. Where appropriate, ensuring that subcontractors and/or suppliers are engaged via appropriate contractual arrangements, ensuring the flow-down of back-to-back provisions and client obligations as appropriate.

  • When required, providing support to the post-contract project teams, ensuring contracts are understood and obligations are met in accordance with the agreed terms and conditions.

Experience and Skills

  • A relevant number of years' experience in a similar role

  • Prior experience working in the pre-award commercial setting.

  • An excellent communicator, with an ability to understand and communicate complex execution models.

  • Able to demonstrate a cognizance for understanding and applying all relevant corporate policies and procedures.

  • The ability to demonstrate a clear understanding of different commercial models and a willingness to think differently around these. Clearly able to articulate different contracting strategies and the pros and cons of different approaches.

  • Experience in managing project commercial issues in the oil and gas, petrochemical and renewable energy and energy transition environments.

Qualifications:

  • Degree in Science, Engineering, Business, Law, Finance, Management, or Quantity Surveying along with appropriate professional qualification (preferred)
