Job Summary

The U.S. Census estimated that as of July 1, 2023, more than 744,000 people reside in El Paso County and you will be part of representing the most populous county in the State of Colorado as it delivers essential and critical services to its residents.
As a Senior or Assistant County Attorney assigned as Sheriff’s Legal Advisor, you will represent the El Paso County Sheriff’s Office’s (“EPSO”) interests for the benefit and safety of the public we serve. You will work directly with the Sheriff and EPSO Command Staff and law enforcement officials to assist with subjects such as public safety, law enforcement, civil rights, use of force, operation of a jail, civil sales, and many other matters that arise in a county sheriff’s office. You may also represent clients in litigation that could stem from decisions related to those subjects.
Due to the public safety - oriented nature of this position and EPSO’s needs, this assignment does not carry a remote work component. We are looking for someone who welcomes challenges, enjoys working on legal novel issues in a dynamic environment, and can work both independently and as part of a team. In this position you will develop meaningful and lasting relationships with your clients whose charge is to deliver critical public safety services.
Assistant County Attorney
Full Salary Range: $96,140.00 - 144,250.00
Hiring Range: $100,000.00 - $120,000.00
Senior County Attorney
Full Salary Range: $119,190.00 - 178,770.00
Hiring Range: $125,000.00 - $148,000.00
This position has an anticipated work schedule of Monday – Friday, 8:00am – 5:00pm, subject to change.

Serves at the will and pleasure of the County Attorney. Provides legal services, advice, and representation regarding the County's legal affairs. Assumes and coordinates major specialized projects as assigned by the County Attorney.
Additionally, the Senior County Attorney l eads and participates in complex and difficult work providing a full range of legal services to County government operations and performs a variety of complex and technical tasks relative to litigation and assigned area of responsibility.
Essential Duties/Responsibilities
Prepares, drafts, and develops a variety of legal documents, including pleadings, motions, briefs, memoranda, policies, contracts, resolutions, and agreements.
Appears before courts and administrative proceedings at the State and Federal level to represent the County's interests as required.
Represents the County in civil litigation and administrative hearings.
Under the direction of the County Attorney, performs liaison responsibilities related to managing, overseeing, and coordinating the development and implementation of major specialized projects.
Prepares and participates in the development of policies; trains various County staff in implementing policy.
Leads, plans, and coordinates the work of staff responsible for special legal projects.
Provides legal advice and support to Elected Officials, Boards, Commissions, and Committees.
Researches and provides written and verbal legal opinions on County transactional, local government, and litigation matters.
Is readily available for consultation with the County Attorney, County Attorney’s Office staff, departmental representatives, and Elected or Appointed Officials.
Attends and participates in professional group meetings; stays abreast of trends and new innovations in county government and in other assigned areas of the law.
May manage trials including, but not limited to, gathering, analyzing, and organizing evidence, conducting discovery, meeting court and rule-imposed time deadlines, interviewing, and preparing witnesses for deposition and trial preparation of pre-trial and post-trial pleadings, motions, briefs; conducts jury selection, presentation of opening and closing statements, the direct, cross examination and re-direct examination of witnesses, and preparation of all post-trial matters, including preparation of appellate level briefs.
Provides assistance to the County Attorney.
Performs other duties as required.
Senior County Attorney:
Represents the County in complex civil litigation and administrative hearings. Handles complex and major civil litigation as assigned; prepares and submits pleadings and motions. Reviews evidence, interviews witnesses, prepares pre-trial memoranda, selects juries, prepares and presents opening and closing statements, examines and cross-examines witnesses, and manages all phases of litigation and post-trial matters.
Provides legal advice and support to Elected Officials, Boards, Commissions, and Committees. May serve as a liaison to the Board of County Commissioners regarding pending litigation. Presents litigation matters to the Board in executive sessions as appropriate.
Performs complex legal research in connection with court filings and writing legal opinions. Drafts complex legal pleadings and briefs.
Possesses extensive government knowledge on a wide variety of practice areas related to the County's legal affairs and is readily available for consultation with the County Attorney, Assistant County Attorneys, County department directors and staff, and County Elected and Appointed Officials.
Attends and participates in professional group meetings; stays abreast of trends and new innovations in county government and in other specified assigned areas of the law.
Manages all aspects of complex and lengthy trials including, but not limited to, gathering, analyzing, and organizing evidence, conducting discovery, meeting court and rule-imposed time deadlines, interviewing and preparing witnesses for deposition and trial preparation of pre-trial and post-trial pleadings, motions, briefs; conducts jury selection, presentation of opening and closing statements, the direct, cross examination and re-direct examination of witnesses, and preparation of all post-trial matters, including preparation of appellate level briefs.
May supervise litigation cases handled by assigned attorneys. Suggests trial tactics, legal motions, lines of investigation, and appropriate dispositions. Reviews and discusses trial preparation and case presentations.
Provides assistance to the County Attorney.
Supervision Exercised: This classification does not have supervisory authority; however, may be required to provide expertise or limited guidance or direction to employees, such as overseeing work quality, training, and guidance. Typically serves as a subject matter expert on the scope of functional area.
Supervision Received: Receives general supervision. This classification typically performs job duties by following established standard operating procedures and/or policies. Regular direction, guidance, and coaching from supervisor may be expected. There is a choice of the appropriate procedure or policy to apply to duties. Performance reviewed periodically.
Qualifications
Knowledge, Skills & Abilities
Thorough knowledge of Federal and State laws, rules, regulations, and procedures concerning county government and administrative/civil judicial processes and judicial decisions interpreting the same.
Discretion both in the ability to make decisions and maintain confidentiality.
Ability to establish effective working relationships with co-workers, superiors, clients, other attorneys, community representatives, the judiciary, and the public. Ability to provide excellent customer service.
Ability to exercise sound and professional judgment in conformance with the policies and procedures of the Office of the County Attorney and the objectives and goals of the County.

Senior County Attorney:
Extensive knowledge and experience handling complex transactions, navigating complex legal and regulatory issues in the areas of real estate and land use, and identifying, resolving, and documenting complex interactions and agreements between government entities and between the government and private sector businesses.
Thorough knowledge of all facets of government, Federal and State laws, rules and regulations, administrative/civil judicial process, and judicial decisions interpreting the same.
Demonstrated ability and success in working in a government and political environment.
Ability to set work priorities and accomplish the same in the required time period. Ability to work independently with minimal supervision or direction. Ability to independently perform highly technical and complex activities.
Ability to exercise tact and impartiality.
Ability to prepare and organize cases. Ability to set work priorities and meet deadlines.
Required Education & Experience
J.D. from an accredited law school required.
Admission to and a member in good standing with the Colorado Bar required within one year of employment; or authorized to practice law in Colorado pursuant to Colorado Rules of Professional Conduct 205.6.
Three years of experience as a practicing attorney.
Senior County Attorney:
J.D. from an accredited law school.
Admission to and a member in good standing with the Colorado Bar required within one year of employment; or
Authorized to practice law in Colorado pursuant to Colorado Rules of Professional Conduct 205.6.
Ten years of experience as a practicing attorney with extensive knowledge and related experience in the area of general civil and local government law; or
Seven years of experience as a practicing attorney with the Civil Division of the County Attorney’s Office.
Preferred Education & Experience
- Experience in civil litigation and government matters.
Licenses/Certificates
Must possess and maintain a valid driver's license.
License in good standing as Attorney and Counselor at Law issued by the Colorado Supreme Court required within one year of employment.
Eligible for admission to U.S. District Court for the District of Colorado and U.S. Court of Appeals 10th Circuit.

Pre-Employment Requirements
- Must pass conditional post offer background investigation, motor vehicle record check, and drug screen.
Work Conditions
Duties are primarily performed in an office, remote, and court environment dependent upon Department discretion and business needs; some travel may be required.
